Terms of Service

Welcome to VisualRef. By accessing or using our websites, applications, and Generative Engine Optimization (GEO) platform (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). Do not use the Services if you do not agree to all of the provisions of these Terms.
1. Use of the Services
VisualRef provides an analytics platform that tracks share of voice, generates content briefs, and provides visibility intelligence across major Large Language Models (LLMs).
- Eligibility: You must be at least 18 years old and capable of forming a binding contract to use the Services.
- Acceptable Use: You agree not to use the Services to scrape data maliciously, reverse-engineer the VisualRef algorithm, or overload our infrastructure with automated API requests outside of provisioned Enterprise tiers.
- Account Responsibility: You are responsible for all activity that occurs under your account credentials. You must strictly guard your API keys and administrative access tokens.
2. Intellectual Property
All rights, title, and interest in and to the Services (excluding Customer Data) are and will remain the exclusive property of VisualRef and its licensors. The VisualRef name, logos, and proprietary GEO scoring algorithms are protected by copyright, trademark, and other laws.
Customer Data: You retain all ownership rights to the URLs, proprietary content, and analytics configurations you submit to the platform. By using the Services, you grant VisualRef a limited, non-exclusive license to process this data solely for the purpose of providing the Services to you.
3. Subscriptions and Billing
Some features of the Services are billed on a subscription basis ("Subscriptions"). You will be billed in advance on a recurring and periodic schedule (e.g., monthly, annually) depending on the type of subscription plan you select.
Unless canceled before the end of the applicable billing cycle, your Subscription will automatically renew. All payment metrics are strictly managed through our PCI-compliant payment gateway infrastructure.
4. Dependency on Third-Party Large Language Models
VisualRef provides intelligence regarding your brand's standing within third-party LLMs (such as Google AI Overviews, ChatGPT, Claude, etc.). We do not control these third-party engines. VisualRef is not liable for fluctuations in your AI ranking, share of voice, or algorithmic changes made by these underlying models that may affect the accuracy of historical tracking data.
5. Limitation of Liability
To the maximum extent permitted by applicable law, VisualRef shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, resulting from (A) your access to or use of or inability to access or use the Services; (B) any unauthorized access to our secure servers; or (C) the outcomes of implementing AI search optimization strategies based on our analytics.
6. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. For material changes, we will provide at least 30 days' notice prior to any new terms taking effect via an alert within the VisualRef application.
7. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
